Contestualmente, sono stati analizzati e implementati, ove ritenuto necessario, specifici presidi di controllo volti a mitigare i rischi individuati. L\u2019individuazione delle attivit\u00e0 a rischio di reato e la successiva individuazione e implementazione di specifici strumenti di controllo e prevenzione, ha rappresentato quindi il momento fondamentale da cui si \u00e8 proceduto alla successiva redazione del Modello. Il documento finale \u00e8 stato redatto sulla base del Decreto, delle Linee Guida emanate da Confindustria e degli orientamenti giurisprudenziali in materia.<\/span><\/p>\n<p style=\"text-align: left;\"><span class=\"colour\">Il processo di revisione \u00e8 culminato nell&#8217;adozione, da parte del Consiglio di Amministrazione, di un nuovo &#8220;Modello di organizzazione, gestione e controllo ai sensi del D.Lgs. n. 231\/2001&#8221;.<\/span><span class=\"colour\"><br \/>\n<\/span><\/p>\n<p style=\"text-align: left;\"><span class=\"colour\">Il Modello \u00e8 affiancato da un apparato disciplinare e sanzionatorio, affinch\u00e9 possa rappresentare uno strumento concreto ed efficace a supporto di una gestione societaria trasparente, corretta e ispirata a principi di integrit\u00e0.<\/span><\/p>\n<p style=\"text-align: left;\"><span class=\"colour\"><span class=\"font\">Il Modello disciplina inoltre la costituzione e il funzionamento dell\u2019Organismo di Vigilanza, attualmente in composizione collegiale, nelle persone del dott. Stefano Mengoni, Presidente, dell\u2019Avv. Paolo Corti e dell\u2019Avv.<\/span><span class=\"font\"> Stefano <\/span><span class=\"font\">Romito. A tale organismo \u00e8 affidato il compito di vigilare sul funzionamento e sull\u2019osservanza del Modello di organizzazione e gestione ai sensi del D.Lgs. 231\/2001, nonch\u00e9 di sovrintendere all\u2019applicazione del Codice Etico e di Comportamento adottato dalla Societ\u00e0.<\/span><\/span><\/p>\n<p style=\"text-align: left;\"><span class=\"colour\">In linea con quanto richiesto dal Decreto e dai principali riferimenti in materia, l\u2019Organismo di Vigilanza opera nel rispetto dei requisiti di autonomia, indipendenza e professionalit\u00e0.<\/span><\/p>\n<p style=\"text-align: left;\"><span class=\"colour\">L\u2019osservanza del Modello di organizzazione, gestione e controllo e del Codice Etico da parte dei collaboratori di InRail S.p.A. riveste un ruolo essenziale: essi contengono un insieme di regole di condotta e principi etici che devono essere conosciuti e rispettati da chiunque instauri rapporti contrattuali con la Societ\u00e0.<\/span><span class=\"colour\"><br \/>\n<\/span><\/p>\n<p style=\"text-align: left;\"><span class=\"colour\">Tale osservanza rappresenta un elemento fondamentale per garantire la corretta operativit\u00e0, l&#8217;affidabilit\u00e0 e
